Terms of Service

By accessing and using TextSmithPro ("Service") through any platform including our web application, Chrome browser extension, or Android mobile application, you accept and agree to be bound by the terms and provisions of this agreement.

If you do not agree to abide by these terms, please do not use this service on any platform.

TextSmithPro is an AI-powered writing assistant available across multiple platforms:

• Web Application: Accessible through modern web browsers at textsmithpro.com
• Chrome Browser Extension: Quick-access writing tools directly in your browser
• Android Mobile Application: Full-featured mobile app available on Google Play Store (package name: cloud.nexovia.textsmithpro)

Our service provides various AI-powered writing tools including:

• Paraphrasing and rewriting tools
• Grammar and spell checking
• Text summarization
• Translation services
• Citation generation
• Plagiarism detection
• AI content humanization
• Image generation
• AI chat assistant
• Additional writing and editing features

Registration

To access certain features, you must create an account by providing accurate and complete information. Your account credentials work across all platforms (web, Chrome extension, and mobile app).

Cross-Platform Access

Your TextSmithPro account provides:

• Single sign-on across web, Chrome extension, and Android mobile app
• Synchronized preferences and settings across all platforms
• Unified usage tracking and subscription management
• Access to your processing history across devices

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials across all platforms
• All activities that occur under your account on any platform
• Notifying us immediately of any unauthorized use
• Keeping your mobile device secure if logged into our mobile app

You agree not to use TextSmithPro for:

• Any unlawful purpose or to solicit others to perform unlawful acts
• Violating any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• Infringing upon or violating our intellectual property rights or the intellectual property rights of others
• Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating, or discriminating
• Submitting false or misleading information
• Uploading or transmitting viruses or any other type of malicious code
• Collecting or tracking the personal information of others
• Spamming, phishing, pharming, pretexting, spidering, crawling, or scraping
• Any obscene or immoral purpose or to encourage anyone else to do the same

Mobile Application Specific Restrictions

When using our Android mobile application, you additionally agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app
• Modify, adapt, translate, or create derivative works based on the app
• Remove, obscure, or alter any proprietary notices or labels on the app
• Bypass, disable, or interfere with security features or in-app purchase mechanisms
• Redistribute, sell, rent, lease, sublicense, or otherwise transfer the app to any third party
• Use the app on any device that has been rooted or jailbroken
• Upload or distribute any files containing viruses, corrupted files, or malicious code that may damage the app or other users' devices

Google Play Store Distribution

Our Android mobile application is distributed exclusively through the Google Play Store. By downloading and using the mobile app, you also agree to comply with:

• Google Play Terms of Service
• Google's payment and refund policies
• Android operating system terms and conditions

App Updates and Compatibility

• Updates: We may release updates to improve functionality, fix bugs, or add features. You are responsible for keeping the app updated to the latest version.
• Device Requirements: The app requires Android 6.0 (API level 23) or higher. Performance may vary based on device specifications.
• Compatibility: We strive to support a wide range of Android devices, but cannot guarantee compatibility with all devices or custom Android implementations.
• Version Support: We may discontinue support for older app versions. Continued use of the service may require updating to the latest version.

Mobile Data and Connectivity

• Internet Required: Most features require an active internet connection (Wi-Fi or cellular data).
• Data Charges: You are responsible for any mobile data charges incurred while using the app. We recommend using Wi-Fi for heavy usage to avoid excessive data charges.
• Offline Functionality: Limited offline functionality may be available (viewing cached history), but AI processing features require internet connectivity.

In-App Purchases

The mobile app offers in-app purchases for:

• Pro subscription (monthly or annual)
• Additional feature credits or add-ons

All in-app purchases are processed through Google Play Billing and are subject to Google's payment terms and refund policies.

Billing

• Subscription fees are billed in advance on a monthly or annual basis
• Web Platform: Payments are processed through our secure payment provider, Stripe
• Mobile Platform: Payments are processed through Google Play Billing
• Fees are non-refundable except as required by law or payment platform policies

Cross-Platform Subscriptions

Subscriptions purchased on any platform (web or mobile) provide access across all platforms:

• Subscribe on web, use on mobile and Chrome extension
• Subscribe through Google Play, use on web and Chrome extension
• Subscription status syncs automatically across all platforms

Mobile Subscription Management

For subscriptions purchased through Google Play:

• Subscriptions are managed through your Google Play account
• To cancel, manage, or view subscription details, go to Google Play Store > Subscriptions
• Refund requests must be submitted through Google Play Store
• Billing disputes should be directed to Google Play support

Cancellation

• Web Subscriptions: Cancel anytime from your account dashboard
• Mobile Subscriptions: Cancel through Google Play Store settings
• Upon cancellation, your access to paid features continues until the end of your current billing period
• No refunds for the current billing period except as required by applicable law or payment platform policy

Refund Policy

• Web Purchases: Subject to our refund policy; contact support@textsmithpro.com
• Mobile Purchases: Subject to Google Play's refund policy; request refunds through Google Play Store
• Refunds are granted at our or the payment platform's sole discretion

Your Content

You retain ownership of any text content you input into our service. By using our service, you grant us a limited license to process your content solely to provide our AI writing services.

Our Service

TextSmithPro and its original content, features, and functionality are and will remain the exclusive property of TextSmithPro and its licensors.

AI-Generated Content

Content generated by our AI tools is provided "as is." While we strive for accuracy, you are responsible for reviewing and verifying all AI-generated content before use.

Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. We may suspend or discontinue the service for maintenance or other reasons.

AI Accuracy

Our AI tools are designed to assist with writing but may not always produce perfect results. Users should review and verify all AI-generated content.

Mobile Application Disclaimers

• Device Performance: App performance may vary depending on your device hardware, operating system version, and available resources.
• OS Compatibility: We support Android 6.0 and above. Functionality on older or modified Android versions is not guaranteed.
• Network Connectivity: Most features require internet connectivity. We are not responsible for network-related issues or mobile data charges.
• Third-Party Dependencies: The app relies on Google Play Services and other third-party libraries. Issues with these services may affect app functionality.
• Device Modifications: Use of the app on rooted devices or devices with modified operating systems may result in reduced functionality or security risks.

Limitation of Liability

TextSmithPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service on any platform, including but not limited to:

• Device damage or data loss from app usage
• Network connectivity issues or data charges
• Google Play Store or payment processing issues
• Incompatibility with specific devices or OS versions

Google Play Store

Our Android mobile application is distributed through Google Play Store. By downloading and using the app through Google Play:

• You agree to comply with Google Play's Terms of Service
• You acknowledge that Google may collect data according to their privacy policy
• App availability, updates, and removal are subject to Google Play policies
• Payment processing and refunds are governed by Google Play's policies

Third-Party Responsibility

We are not responsible for:

• Google Play Store availability or technical issues
• Changes to Google's terms, policies, or fee structure
• Decisions by Google to remove or restrict our app
• Issues with payment processing through Google Play Billing
• Your device manufacturer's policies or limitations
• Mobile carrier restrictions or charges

Platform Changes

We reserve the right to modify, suspend, or discontinue the mobile app or any platform version at any time without notice. Platform-specific features may differ based on technical capabilities and platform policies.

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices.

We may terminate or suspend your account and bar access to the service on all platforms (web, Chrome extension, and mobile app) immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever including without limitation if you breach these Terms.

Effect of Termination

Upon termination:

• Your access to all platforms will be immediately revoked
• Mobile app will cease to function (authentication will fail)
• Any outstanding subscription obligations remain in effect
• We may delete your account data according to our data retention policy

Voluntary Termination

If you wish to terminate your account:

• Cancel your subscription on the platform where you purchased it
• Contact us at support@textsmithpro.com to request account deletion
• Uninstall the mobile app from your device
• Remove the Chrome extension from your browser

Note: Uninstalling the mobile app or removing the extension does not cancel your subscription. You must cancel through the appropriate platform.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

We will notify you of changes through:

• Email notification to your registered email address
• In-app notifications on the mobile application
• Prominent notice on our web application
• Updates to the "Last updated" date at the top of this page

Your continued use of any platform after changes take effect constitutes acceptance of the modified terms.

These Terms shall be interpreted and governed by the laws of Illinois, United States, without regard to conflict of law provisions.
